Website Terms of Use

Rules and conditions for using the Tyner Physical Therapy public website

Effective October 1 2026

This website policy is not a substitute for any HIPAA Notice of Privacy Practices or other patient notice required by law.

These Website Terms of Use (the "Terms") govern your access to and use of tynerpt.com and any Tyner Physical Therapy website that links to these Terms (the "Site"). The Site is operated by Tyner Physical Therapy ("Tyner PT," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Website Information Is Not Medical Advice

The Site provides general information about Tyner PT, physical therapy, pelvic-floor therapy, training, movement assessment, injury prevention, and related topics. Site content is provided for general educational and informational purposes. It is not medical advice, diagnosis, treatment, or a substitute for an in-person evaluation by a qualified health care professional.

Do not disregard professional medical advice or delay seeking care because of information on the Site. Results and treatment needs vary. Nothing on the Site guarantees a particular diagnosis, outcome, recovery time, number of visits, insurance payment, or level of improvement.

2. Emergencies

The Site and its contact form are not monitored as emergency services. If you believe you are experiencing a medical emergency, call 911 or seek immediate emergency care. Do not use the Site, email, or a website form to request urgent medical assistance.

3. No Clinician Patient Relationship Through the Site

Viewing the Site, sending a message, requesting an appointment, or receiving an administrative response does not by itself create a clinician-patient relationship. A clinician-patient relationship begins only when Tyner PT accepts you for care and provides services under the arrangements applicable to that care. Site communications are not a substitute for evaluation, consent, or clinical documentation.

4. Appointment Requests

A request submitted through the Site is not a confirmed appointment. Tyner PT must respond and expressly confirm the location, provider, service, date, and time. Availability may change. Tyner PT may determine that a requested service is not appropriate or that another provider or level of care should be considered.

You are responsible for providing accurate contact information and for notifying Tyner PT if your availability or contact information changes. Cancellation, late-arrival, payment, and treatment policies provided during scheduling or intake may apply in addition to these Terms.

5. Insurance and Payment Information

Any Site statement about insurance participation, out-of-network benefits, Medicare, claim submission, payment plans, or pricing is general information and may change. Coverage depends on the patient’s plan, eligibility, authorization requirements, medical necessity rules, deductibles, copayments, coinsurance, benefit limits, and other terms. Tyner PT cannot guarantee that an insurer will authorize, cover, or reimburse a service.

You are responsible for confirming benefits with your insurer and for amounts not paid by insurance, subject to applicable law and any written agreement with Tyner PT. A referral or prescription may be required by law, an insurer, Medicare, or a treating clinician even if the Site states that many patients may begin without one.

6. Appropriate Use of the Site

You may use the Site only for lawful, personal, and informational purposes. You agree not to:

  • Use the Site in violation of law or another person’s rights

  • Submit false, misleading, fraudulent, abusive, threatening, discriminatory, or unlawful content

  • Attempt to gain unauthorized access to the Site, accounts, systems, or data

  • Interfere with Site operation, security, or availability, including by introducing malware or excessive automated traffic

  • Scrape, harvest, or collect information from the Site through automated means except as permitted by law and our written authorization

  • Impersonate another person or misrepresent your identity or authority

  • Use Site content to train a commercial artificial-intelligence system or create a competing commercial resource without written permission, except where such restriction is prohibited by law

We may restrict or terminate access to the Site if we reasonably believe use violates these Terms, threatens security, or interferes with other users.

7. Information You Submit

You remain responsible for information you submit through the Site. You represent that you have the right to provide it and that it is accurate to the best of your knowledge. Do not submit another person’s health or contact information unless you are authorized to do so.

Do not submit detailed medical records, test results, insurance identification numbers, Social Security numbers, payment-card information, or other sensitive information through the general contact form or ordinary email. Use only the communication method Tyner PT designates for clinical, billing, or patient-record information. Our handling of personal information collected through the public Site is described in the Website Privacy Policy.

8. Intellectual Property

The Site and its text, graphics, logos, photographs, videos, design, arrangement, and other content are owned by Tyner PT or used with permission and are protected by intellectual-property laws. Tyner Physical Therapy, Tyner PT, associated logos, and other brand elements may be trademarks or service marks of their respective owners.

We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for your personal, noncommercial use. You may print or save a reasonable number of pages for that purpose if you preserve notices and do not alter the content. No other right is granted. You may not reproduce, distribute, modify, publicly display, sell, license, or create derivative works from Site content without prior written permission, except as permitted by law.

9. Third Party Links and Services

The Site may link to maps, social networks, scheduling services, insurer resources, or other third-party websites and services. Those resources are provided for convenience. Tyner PT does not control and is not responsible for their availability, content, security, products, or practices. A link does not imply endorsement. Your use of a third-party service is governed by that service’s terms and privacy policy.

10. Accuracy and Availability

We try to keep Site information accurate and current, but content may contain errors, omissions, or outdated information. Services, clinicians, locations, hours, availability, insurance arrangements, and Site features may change without notice. We may modify, suspend, or discontinue all or part of the Site at any time. We do not promise that the Site will always be available, secure, or free from errors or harmful components.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TYNER PT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. THIS DISCLAIMER DOES NOT EXCLUDE A WARRANTY THAT CANNOT LAWFULLY BE EXCLUDED.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TYNER PT AND ITS OWNERS, CLINICIANS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.

TO THE FULLEST EXTENT PERMITTED BY LAW, TYNER PT’S TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING ANY RIGHTS YOU MAY HAVE UNDER APPLICABLE CONSUMER-PROTECTION LAW. THESE TERMS DO NOT LIMIT LIABILITY ARISING FROM PROFESSIONAL HEALTH CARE SERVICES UNDER A SEPARATE CLINICIAN-PATIENT RELATIONSHIP.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Tyner PT and its owners, clinicians, employees, contractors, and agents from third-party claims, liabilities, damages, judgments, awards, losses, costs, and reasonable attorneys’ fees arising from your unlawful misuse of the Site, your material violation of these Terms, or content you submit in violation of another person’s rights. This section does not require a consumer to indemnify Tyner PT for Tyner PT’s own unlawful conduct.

14. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to any rights that cannot be waived, a claim concerning the Site or these Terms must be brought in a state or federal court located in New York County, New York. You and Tyner PT consent to personal jurisdiction and venue in those courts. This section does not govern professional-liability or patient-care disputes to the extent another agreement or law applies.

15. Changes to These Terms

We may revise these Terms when the Site, our practices, or legal requirements change. The effective date at the top shows when the Terms were last revised. Revised Terms apply when posted unless a later date is stated. Your continued use of the Site after revised Terms take effect means you accept them, to the extent permitted by law.

16. General Provisions

If a provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms, together with the Website Privacy Policy and any notices expressly incorporated by reference, are the entire agreement concerning use of the public Site. Separate patient, payment, scheduling, consent, and privacy documents may govern health care services.
